Description

5.Contracting authority:The Office of the Minister of State for Administrative Reform, Beirut, LEBANON.

6.Description of the contract:OMSAR intends to implement the following works:• a sanitary landfill in Baalbek, Lebanon with a capacity of 1 000 000 m3 including lining for phase A,• a steel hangar to house the sorting plant in Baalbek, Lebanon (about 3 400 m2),• a sanitary landfill in Srar-Akkar, North Lebanon with a capacity of 280 000 m3,• a steel hangar to house the sorting plant in Srar-Akkar (about 2 800 m2);• concrete platform for composting and maturation (about 5 000 m2) part of the Srar-Akkar facility, and• a sanitary landfill in Joub Janine, West Bekaa, Lebanon with a capacity of 54 000 m3.

7.Number and titles of lots:Lot 1: construction of a sanitary landfill in Srar-Akkar.Lot 2: construction of a sanitary landfill in Baalbek.Lot 3: construction of a sanitary landfill in Joub Janine.Lot 4: construction of 2 steel hangars in Baalbek and Srar, and complimentary works.

8.Eligibility and rules of origin:Participation is open to all natural persons who are nationals of, and legal persons (participating either individually or in a grouping — consortium — of tenderers) which are effectively established in, a Member State of the European Union or in an eligible country or territory as defined under the Regulation (EU) No 236/2014 of the European Parliament and of the Council of 11.3.2014 laying down common rules and procedures for the implementation of the Union"s instruments for financing external action (CIR) for the applicable instrument under which the contract is financed (see also heading 22 below). Participation is also open to international organisations. All supplies under this contract must originate in 1 or more of these countries. However, they may originate from any country when the amount of the supplies to be purchased is below 100 000 EUR per purchase.

9.Grounds for exclusion:Tenderers must submit a signed declaration, included in the tender form for a works contract, to the effect that they are not in any of the situations listed in point 2.3.3 of the ‘Practical Guide’.

10.Number of tenders:Tenderers may submit only 1 tender per lot. Tenders for parts of a lot will not be considered. Any tenderer may state in its tender that it would offer a discount in the event that its tender is accepted for more than 1 lot. Tenderers may not submit a tender for a variant solution in addition to their tender for the works required in the tender dossier.

11.Tender guarantee:Tenderers must provide a tender guarantee of 35 000 EUR for lot 1, 35 000 EUR for lot 2, 15 000 EUR for lot 3 and 45 000 EUR for lot 4 when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderers(s) upon signature of the contract by all parties.

12.Performance guarantee:The successful tenderer will be asked to provide a performance guarantee of 10 % of the amount of the contract at the signing of the contract. This guarantee must be provided together with the return of the countersigned contract no later than 30 days after the tenderer receives the contract signed by the contracting authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next cheapest compliant tender.

13. Information meeting and/or site visit:An optional information meeting will be held by the contracting authority on 17.5.2017 (12:00) at the following address:Office of the Minister of State for Administrative Reform, Starco Bldg, Block A, 5th Floor, Room 520, Omar Daouk St., Beirut, LEBANON.

14.Tender validity:Tenders must remain valid for a period of 90 days after the deadline for submission of tenders. In exceptional circumstances, the contracting authority may, before the validity period expires, request that tenderers extend the validity of tenders for a specific period.

15.Period of implementation of tasks:The period of implementation of tasks shall be 12 months for each lot as from the commencement order.

16.Selection criteria:Technical and financial capacities of the tenderer are as detailed below (also refer to the instructions to tenderers document in Section 12.2):— In order to be eligible for the award of the contract, tenderers must provide evidence that they meet the selection criteria. This must be provided by tenderers using the forms described in 12.1 and any additional forms tenderers may wish to use.If a tender is submitted by a consortium, unless specified, the selection criteria will be applied to the consortium as a whole.1. Economic and financial capacity of candidate:The selection criteria for tenderers to lot No 1 are as follows:a) the average annual turnover of the tenderer in the past 3 years must be at least 3 000 000 EUR;b) if it is the sole tenderer, the tenderer must have access to sufficient credit and other financial facilities to cover the required cash flow for the duration of the contract. In any case, the amount of credit available must exceed the equivalent of 2 000 000 EUR.The selection criteria for tenderers to lot No 2 are as follows:a) the average annual turnover of the tenderer in the past 3 years must be at least 3 000 000 EUR;b) if it is the sole tenderer, the tenderer must have access to sufficient credit and other financial facilities to cover the required cash flow for the duration of the contract. In any case, the amount of credit available must exceed the equivalent of 2 000 000 EUR.The selection criteria for tenderers to lot No 3 are as follows:a) the average annual turnover of the tenderer in the past 3 years must be at least 1 200 000 EUR;b) if it is the sole tenderer, the tenderer must have access to sufficient credit and other financial facilities to cover the required cash flow for the duration of the contract. In any case, the amount of credit available must exceed the equivalent of 600 000 EUR.The selection criteria for tenderers to lot No 4 are as follows:a) the average annual turnover of the tenderer in the past 3 years must be at least 6 000 000 EUR;b) if it is the sole tenderer, the tenderer must have access to sufficient credit and other financial facilities to cover the required cash flow for the duration of the contract. In any case, the amount of credit available must exceed the equivalent of 3 000 000 EUR.Technical and professional capacity of candidate:The selection criteria for tenderers to each of the lot Nos 1, 2, 3 and 4 are as follows:a) the tenderer must have completed at least 2 projects of the same nature/complexity as the works of the concerned lot and successfully implemented them during the following period: 8 years preceding the submission deadline, and each of them exceeding the financial offer of the tendered lot. The contracting authority reserves the right to ask for copies of certificates of final acceptance signed by the supervisors/contracting authority of the projects concerned.(This means that the project the tenderer refers to could have been started/implemented/completed at any time during the indicated period but it does not necessarily have to be started and completed during that period, nor implemented during the entire period.);b) all its key staff must have the following profile:i. for lots 1, 2 and 3 (separately for each lot):• project manager,• surveyor,• geotechnical expert (or equivalent);ii. for lot 4:• project manager,• steel design engineer.2. In case a tenderer applies for more than 1 lot, the tenderer must comply with the following selection criteria:Economic and financial capacity of candidate:a) the average annual turnover of the tenderer in the past 3 years must be at least equal to the sum of the annual turnovers required for the respective lots being applied to as indicated in Section 12.2.1;b) the tenderer must have access to sufficient credit and other financial facilities to cover the required cash flow for the duration of the contract. In any case, the amount of credit available must exceed the equivalent of 75 % of the turnover required in point a) above.Technical and professional capacity of candidate:Case; lots tendered; technical capacity; professional capacity:1; any 2 lots of lots 1, 2 or 3; at least 2 projects complying with technical capacity (a) above, each of them exceeding the maximum financial offer between the 2 lots; 2 project managers, 2 surveyors and 2 geotechnical engineers;2; lots 1, 2 and 3; at least 3 projects complying with technical capacity (a) above, each of them exceeding the maximum financial offer among the 3 lots; 3 project managers, 3 surveyors and 3 geotechnical engineers;3; any 1 of the lots (1, 2 or 3) and lot 4; at least 4 projects complying with technical capacity (a) above (2 for each lot tendered); lots (1 and 4) or (2 and 4): 2 project managers, 1 surveyor, 1 geotechnical engineer, and 1 steel design engineer. Lots (3 and 4): 3 project managers, 1 surveyor, 1 geotechnical engineer, and 1 steel design engineer;4; any 2 of the lots (1, 2 or 3) and lot 4; at least 4 projects complying with technical capacity (a) above: — 2 projects for lot 4, — 2 projects for any 2 of the lots (1, 2 or 3) each of them exceeding the maximum financial offer between the 2 lots; lots (1, 3 and 4) or (2, 3 and 4): 3 project managers, 1 surveyor, 1 geotechnical engineer, and 1 steel design engineer. Lots (1, 2 and 4): 2 project managers, 1 surveyor, 1 geotechnical engineer, and 1 steel design engineer;5; all 4 lots; at least 5 projects complying with technical capacity (a) above (3 projects for lots 1, 2 and 3, each of them exceeding the maximum financial offer among the 3 lots; and 2 projects for lot 4); 3 project managers, 3 surveyors, 3 geotechnical engineers and 1 steel design engineer.

17.Award criteria:The most economically advantageous tender is the technically compliant tender with the lowest price.

22.Repetition of similar works:Subsequent to the initial contract resulting from the current tender procedure, new works consisting in the repetition of similar works, up to the estimated amount of 1 800 000 EUR for lot 1, 1 800 000 EUR for lot 2, 400 000 EUR for lot 3 and 1 000 000 EUR for lot 4 may be entrusted to the initial contractor by negotiated procedure without prior publication of a contract notice, provided the new works are in conformity with the same basic project.
